This couldn't be true, it only happens at USU! And it never happens at the other school since they aren't required to provide any information to anyone (being private and all, and there it's an honor code violation, usually against the "temptress")

Sure, how Utah handles things has been about as bad as it gets. When I lived in SLC, I met several girls who spoke about how bad the Campus Police was at dealing with things ranging from assault to stalking. The McCluskey tragedy happened after I moved away from SLC. Hopefully that was a wake up call to take these things far more seriously.

She alleges rape by a Ute football player. What was UVU supposed to do? They can’t expel a student that doesn’t attend their school. It doesn’t sound as if they denied counseling and other forms of support.

What was Utah supposed to do? They aren’t able to protect her rights to not be excluded from education on the basis of sex because she doesn’t attend their school either. The strongest argument against Utah would be from the next person the football player assaults on that is a Ute student.

I’m trying to be sympathetic to both this woman and the woman that alleges assault against a USU player but both are making ridiculous demands that are literally impossible to comply with.

She could go to the police and resolve all of it. They could use appropriate investigative power and they can charge a criminal as the criminal deserves. They are expecting way too much.

Ideally I agree. I don’t know how much they can do. That’s what I don’t know about. My understanding is the offices encourage the person making the complaint to report to police but I don’t know if the office is generally able to make a communication like this to the police themselves, let alone another university.

Is UVU denying her participation at UVU because someone not affiliated with UVU assaulted her?

Between the USU girl who expected the title ix office to be able to violate her hipaa rights and get her medical records from the hospital without her cooperation and deny the defendant any sense of due process and this girl who is expecting UVU to discipline someone who isn’t a UVU student or for Utah to protect her title ix rights to not be excluded on the basis of sex, when she’s excluded on the basis of choosing to attend another institution I don’t know what she expects other than to let the police handle it.

Title IX cannot contact police, they can only encourage it. Problem is, Title IX offices across the country actively seek to minimize police involvement in and sex assault case. Not kidding. There's an association of title ix directors and it's actually in the literature and talking points. I'll see if I can find and post.

I have the work history that qualified me to be USU’s Title IX investigator and didn’t even get a call back when I applied in 2019. Maybe I was too competent.

I hate Utah as much as the next guy but what were they supposed to do with the McCluskey case? The guy that killed her wasn't a student was he? It happened on their campus but I don't think it's reasonable to ask their campus police to monitor every entrance to the campus. And I don't think police can escort students to and from classes while they're on campus. It was a tragedy and if I remember right they settled a lawsuit with the family, but I don't understand what more they could have done.

I didn’t like how the one guy shared pictures and seemed to not attempt to investigate the allegation. I don’t know if that is a university wide issue or a specific employee not doing his job.

That’s not like the scenario in the above lawsuit though.
